Types of Investor Visas

EB-5 Visa

According to the US Citizenship and Immigration Services (USCIS), “Congress created the EB-5 Program in 1990 to stimulate the U.S. economy through job creation and capital investment by foreign investors.”

Description and Purpose

The EB-5 Visa allows foreign investors to obtain a US visa by investing in a business that benefits the US economy. This can lead to a green card.

Eligibility Requirements

To qualify, an investor is required to invest a minimum of $1,000,000 or $500,000 in a high-unemployment or rural area.

Job Creation Requirements

Investors are also required to create or preserve 10 or more permanent full-time jobs for US workers.

    E-2 Visa

    Description and Purpose

    The E-2 Visa is for citizens from treaty countries who wish to invest in a US business.

    Investment Requirements

    Have invested, or be actively in the process of investing, a substantial amount of capital in a bona fide enterprise in the United States,” according to the US Citizenship and Immigration Services (USCIS). 

    According to the USCIS, “substantial” means: 

    • Substantial in relationship to the total cost of either purchasing an established enterprise or establishing a new one
    • Sufficient to ensure the treaty investor’s financial commitment to the successful operation of the enterprise
    • Of a magnitude to support the likelihood that the treaty investor will successfully develop and direct the enterprise. The lower the cost of the enterprise, the higher, proportionately, the investment must be to be considered substantial.

    Applicants are also required to be interested in entering the United States to develop and direct the investment enterprise. 

    Finally, the investment is required to be substantial and sufficient to ensure the successful operation of the enterprise.
